Anti-Assignment Act

Background

The Anti-Assignment Act refers to two statutory provisions:

  1. The Assignment of Contracts Act, and
  2. The Assignment of Claims Act.

The Assignment of Contracts Act

  • Prohibits assignment of Government Contracts

The party to whom the US Government gives a contract may not transfer the contract, or any other interest in the contract to another party. The only exception is the assignment of amounts due (receivables) to a financing institution.

The Assignment of Claims Act

  • Prohibits assignment of claims against the United States
